Australian Pole Festival Term & Conditions

1. Agreement

1.1. This agreement is between Australian Pole Festival Pty Ltd (ABN , CAN) (herein referred to as Australian Pole Festival) and the customer described in this contract (herein referred to as the customer).

1.2. Upon acceptance of these contract terms by the customer, the agreement is irrevocable and can only be amended with the written consent of Australian Pole Festival.

1.3. An agreement will be deemed to have been created between the customer and Australian Pole Festival under these contract terms upon the customer signing this contract.

1.4. Australian Pole Festival, its employees, contractors and volunteers reserve the right to refuse entry to the event of any customer or other person whom they deem to be in breach of any of the contract terms listed herein. Management will support staff in this decision where appropriate.

2. Indemnity & Risk

2.1. The customer must indemnify Australian Pole Festival, its employees, contractors and volunteers against any claim, liability, expense, cost, loss or damage for personal injury, death or property damage to any person caused by, or arising out of, or in any way connected with any event of Australian Pole Festival.

2.2. Australian Pole Festival, its employees, contractors and volunteers will not be liable to the customer or any party for any indirect, economic, special or consequential loss or damage, loss of revenue, time, goodwill, data, anticipated savings, opportunity, loss of production or loss of profit.

2.3. The customer agrees that they are aged sixteen (16) years or older. All customers aged less than eighteen (18) years of age require parent and/or guardian consent to attend and participate in Australian Pole Festival, indicated by co-signature of this contract.

2.4. The customer agrees to assess their own level of health and fitness ability before participating in each individual workshop and any and all manoeuvres, tricks and activities.

2.5. The customer agrees to follow all reasonable instructions given by Australian Pole Festival, its employees, contractors and volunteers and venue staff.

2.6. The customer agrees not to engage in, or assist others to engage in any activities which are beyond their limit of health or fitness ability; or where under the influence of alcohol or drugs/ medications that may put the safety of themselves or others at risk.

2.7. The customer agrees not to attempt any workshops or manoeuvres when wearing attire or products such as skin and hair products that are inappropriate and/or unsafe for the activity being attempted or that may cause the equipment to become slippery and/or unsafe for themselves or others.

2.8. A fully qualified First Aid team is on site throughout all workshop periods. The customer agrees to follow all reasonable directions of Australian Pole Festival, its employees, contractors and volunteers in case of an accident or incident that required First Aid and follow all instructions for completing an incident report form.

2.9. All off-site transfers to and from workshops during the event will be accompanied by a staff member who is fully qualified in First Aid. In the event of an incident or accident that occurs off site from the event or in transit between off site workshops, the customer agrees to follow all reasonable instructions given by staff.

3. Media Release

3.1. The customer must indemnify Australian Pole Festival, its employees, contractors and volunteers against any claim for photographs, video footage, television, radio, internet and social media releases of the event.

4. Event Variations

4.1. Australian Pole Festival reserves the right to make changes to the instructor list, workshop list and type of workshop, venue and any other event details. All customers will be notified in writing of any such changes within seven (7) days of the change. 5. Payments & Refunds

5.1. Australian Pole Festival will only accept registrations which us the official online registration form available on the company website and/or Facebook pages.

5.2. The customer agrees to make full payment within 48 hours of registration choosing Direct Bank Transfer or Paypal options. The customer understands that no registration can be held beyond this period where payment is not received into the nominated account of Australian Pole Festival.

5.3. The customer understands that all payment plan options are administered by a third party direct debit organisation “FFA Paysmart” which applies fees that are payable by the customer for setup, debit fees and any other fees and charges as per the DDR Service Agreement. The customer agrees to ensure that sufficient funds are available for debits, or be liable for fees and charges as applied by FFA Paysmart.

5.4. The customer agrees to the following cancellation and refund terms. Customer cancellation of registration for an event are accepted in writing only and will be subject to the following refund terms and conditions:

5.4.1.1. Cancellations requested ≥ 90 days of the event start date will incur a penalty equal to 10% of the total cost of the chosen package. 5.4.1.2. Cancellations requested within 60-90 days of the event start date will incur a penalty of 15% of the total cost of the chosen package.

5.4.1.3. Cancellations requested within 30-60 days of the event start date will incur a penalty of 20% of the total cost of the chosen package.

5.4.1.4. Cancellations requested within ≤ 30 days of the event start date are non-refundable. Name transfers are allowable when submitted in writing and agreed upon by Australian Pole Festival. Australian Pole Festival will not enter into any negotiations between customers and third parties
